Part I
GTS, General Terms of Sale
Applicable to all reservations and rentals
Preamble
Scope and Agency Status
These General Terms of Sale govern all transactions, reservations and rentals concluded on www.lesclesdecharlotte.com or through any direct sales channel operated by SARL LES CLÉS DE CHARLOTTE. The Agency acts as a licensed real estate agent (Professional Card G No. CPI34022026000000033, issued by the Hérault Chamber of Commerce), acting exclusively on behalf and in the name of the property owners.
Article 1
Contractual Framework and Client Profiles
Every contractual relationship is classified upon booking confirmation under one of the three profiles below. The applicable profile determines the legal framework, financial terms and mutual obligations of the parties.
Profile A, Private Traveller (Standard Holiday Stay)
Subject to General Rental Conditions, Stay Module. Strictly excludes any event or festive gathering.
Profile B, Event Organiser (Weddings, Receptions, Celebrations)
Subject to Special Conditions, Event Module, governed by a specific contract. Expressly permits festive use subject to specific insurance and deposit requirements.
Profile C, Corporate Client (Seminars, Team Building, Film Shoots)
Subject to B2B Conditions, Corporate Module. Excludes the application of consumer protection law.
Article 2
Standard Holiday Stay Module (Profile A)
The following rules apply by right to any stay under Profile A, unless otherwise expressly stated in the individual reservation contract.
Payment
A 25% deposit is due at the time of booking. The remaining 75% balance is due 15 days before arrival.
Cancellation policy
Standard cancellation terms apply at 90 days and 30 days before arrival, as defined in the reservation contract.
No-event clause
Any undeclared event or festive gathering is strictly prohibited. Any breach will result in immediate termination of the stay with no refund.
Late check-out
A penalty of €150 per hour applies for any departure beyond the contractual check-out time.
Smoking surcharge
€300 (excl. VAT) applies if smoking inside the property is detected.
Security deposit
To be lodged no later than 3 days before arrival, by bank pre-authorisation or escrow payment as communicated at the time of booking.
Article 3
Events & Weddings Module (Profile B)
Where a booking includes the organisation of a wedding or reception exceeding standard occupancy, the Client is placed under the Events regime, governed by the following provisions:
Event waiver
The no-event clause is lifted exclusively for the event declared in the specific contract. Any extension of scope or change in the nature of the event requires a prior written amendment.
"Structural" security deposit
Increased and adjusted to the event risk, recalculated based on the declared guest count. To be lodged by bank pre-authorisation or escrow transfer no later than 7 days before the event.
Insurance requirement
A valid Event Organiser Public Liability certificate is mandatory and must be provided to the Agency at least 15 days before the event date.
Logistics coordination
A complete list of all external suppliers (caterers, DJs, wedding planners, photographers, etc.) must be submitted to the Agency at least 30 days before the stay for approval.
Article 4
Corporate / B2B Client Module (Profile C)
These provisions govern the relationship between SARL LES CLÉS DE CHARLOTTE and any Client acting in the course of their professional activity.
Exclusion of consumer law
The Client expressly acknowledges that they are not acting as a consumer. Consumer protection provisions do not apply.
Invoicing terms
Invoices are issued in the name of the legal entity with the intra-community VAT number. Late payment penalties: 3 times the legal interest rate, plus a flat recovery fee of €40.
Image rights (Film shoots / Photo shoots)
The special conditions annexed to the contract define the permitted distribution scope, media, exploitation period and territories. Any use beyond this scope is prohibited without prior written consent.
Article 5
Secure Payments and Client Account
All transactions are processed through the Agency's secure payment system. In accordance with the Hoguet Act and its implementing regulations, all sums received on behalf of owners are held in a dedicated client account maintained by SARL LES CLÉS DE CHARLOTTE. These funds are strictly separated from the Agency's own assets and are covered by a specific financial guarantee.
Article 6
Exclusion of Right of Withdrawal
In accordance with Article L.221-28 12° of the French Consumer Code, the 14-day right of withdrawal is expressly excluded for accommodation services to be provided on a specific date or over a defined period.
Any transaction confirmed by the Client is firm and final. It may only be cancelled or amended under the conditions set out in the reservation contract, according to the applicable profile and the deadlines stipulated therein.
Article 7
Governing Law and Dispute Resolution
These General Terms of Sale are governed by French law. In the event of any conflict of interpretation between the French version and any translation, the French version shall prevail.
B2C, Mediation and jurisdiction
In the event of an unresolved dispute, the consumer Client may refer the matter to mediation through ANM CONSO, 2 rue de Colmar, 94300 Vincennes, www.anm-conso.com. The courts having jurisdiction are those of the location of the rented property.
B2B, Jurisdiction clause
Exclusive jurisdiction is attributed to the Commercial Court of Montpellier, even in the event of multiple defendants or third-party claims, notwithstanding any contrary clause.
Part II
GTU, General Terms of Use
In effect as of 1 July 2026
Article GTU 1
Intellectual Property and Anti-Scraping
All content on www.lesclesdecharlotte.com (including architecture, text, photography, video, source code, trademarks, logos and graphic elements) is protected by copyright and constitutes the exclusive property of SARL LES CLÉS DE CHARLOTTE or its principals.
Prohibition of reproduction
Any unauthorised copying, downloading, reproduction, representation or distribution of all or part of the content is strictly prohibited without the Publisher's prior written consent.
Prohibition of data scraping
It is strictly forbidden to scrape content, conduct automated data collection, or use bots or automated agents to harvest information, pricing or photographs, including to feed competing algorithms, price comparison tools or artificial intelligence systems, without the Publisher's prior written consent.
Article GTU 2
Guest Portal Access and Security
As part of their reservation, the User receives access to a personalised temporary digital space (Guest Portal) via a unique URL link and phone number authentication.
This link and the information it contains (including the exact property address, security codes, smart key box instructions and access details) are strictly personal, confidential and non-transferable. The User is solely responsible for keeping their access link confidential and for all activity conducted through their account, whether authorised or not.
Prohibition of sharing
Sharing the access link with third parties not declared at the time of booking is prohibited and may result in immediate termination of the stay.
Access duration
The access link is valid for the duration of the relevant stay only. It is automatically deactivated upon check-out.
Article GTU 3
Technical Availability
The Publisher endeavours to keep the site accessible 24 hours a day, 7 days a week. However, no liability shall be incurred in the event of:
Scheduled maintenance
Temporary interruptions for maintenance, updates or technical improvements to the site and associated services.
Network disruptions
Outages caused by telecommunications network failures or hosting infrastructure issues beyond the Publisher's control.
Cybersecurity incidents
Presence of viruses, malware or external cyberattacks despite the security measures in place.
Article GTU 4
Hyperlinks
The site may contain hyperlinks to partner websites, local tourism offices, service providers or booking platforms. These links are provided for information purposes only. The Publisher has no control over the content of these third-party sites and accepts no liability for their content, data protection practices or availability.
Article GTU 5
Amendments to the GTS and GTU
The Publisher reserves the right to amend these General Terms of Sale and Use at any time to reflect technical, legislative or regulatory changes, or any modification to its commercial terms.
The GTS and GTU applicable to any booking are those in force at the date the booking is confirmed. Users are responsible for checking this page regularly to stay informed of any changes.
